Mosquito Spraying and The Children and Families Protection Act

The Massachusetts Department of Agricultural Resources (DAR) has specific expectations for your IPM plans if you anticipate that spraying for mosquitoes might be necessary. If your school's IPM plan identifies mosquitoes as a pest to be controlled and the includes the pesticides listed below, you should not normally need to request an Emergency Waiver from your local board of health. This would only be necessary if you needed to have the notification time requirements waived (at least two working days prior to spraying).
Please be certain to have both of the below listed pesticides in your IPM plans.
Anvil 10 + 10, with
Sumethrin and Piperonyl as the active ingredients, EPA reg. number
1020-1688-8329.
Duet, with Prallethrin,
Sumethrin and Piperonyl as the active ingredients, EPA reg. number
1021-1795-8329.

If you have not listed the Plymouth County Mosquito Control Project in your IPM plans, you can only be sprayed through the Emergency Waiver Process. See Emergency Waiver Form and Explanation.
Standard Written Notification requires the distribution of three specific documents to students and staff no later than two working days prior to spraying and no earlier than seven working days prior to spraying. There are three options for the notification process. Schools can choose to issue hard copies of the documents. This could mean six or seven pages/student and employee. There are two electronic options available as well. The first option is notification by email and the second option is notification by the school website. For Option details select View Options.
The three required documents are the Pesticide Standard Written Notification Form (one page), the Consumer Bulletin, and the Pesticide Fact Sheet.

Once you have completed Standard Written Notification, the law requires that we receive a signed and dated statement to this effect prior to our pesticide application. This statement should be faxed to 781-582-1276.
Reminder
of School Obligations
The law requires that each time a school requests to be sprayed, Standard Written Notification has to be given to students, parents and employees at least two working days prior to the application and no more than seven working days prior to the pesticide application. Additionally, records of pesticide applications must be kept on file for five years.
